These Terms of Service ("Terms") govern your use of the Pear Notes application ("the app", "Pear Notes") on all platforms (iOS, Android, macOS, Windows). By downloading, installing, or using Pear Notes, you agree to be bound by these Terms.
By accessing or using Pear Notes, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the app.
Pear Notes is a private, encrypted note-taking application that stores all data locally on your device. The app provides:
You own all content you create within Pear Notes. Since all data is stored locally on your device and synced peer-to-peer, you are solely responsible for:
Pear Notes generates a unique 64-character private key for encrypting your data and backups. This key cannot be recovered if lost. You are solely responsible for storing your private key securely. We cannot access, reset, or recover your encryption key or any data encrypted with it.
You agree to use Pear Notes in compliance with all applicable local, national, and international laws and regulations. You may not use the app to store or transmit content that violates any law.
This applies equally to the app's optional AI features, which generate text on your device. You may not use them to produce content that is unlawful, that infringes the rights of others, or that breaches the policies of the store from which you obtained the app. You remain responsible for any content you generate with them and for how you use it.
The Pear Notes application, including its design, code, icons, and branding, is the intellectual property of Pear Notes and its developer. You are granted a limited, non-exclusive, non-transferable license to use the app for personal purposes in accordance with these Terms.
Pear Notes is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the app will be error-free, uninterrupted, or free of harmful components.

While we strive to ensure reliable peer-to-peer synchronization, network conditions, NAT configurations, and device compatibility may affect sync performance. We do not guarantee that synchronization will always succeed in all network environments.
The app's AI features are optional, are off until you turn them on, and run entirely on your device using open models you choose to download. The text they produce — transcripts, extracted text, image descriptions, summaries, titles, key points, rewrites, translations, and answers to questions about a note — is generated by statistical models and may be inaccurate, incomplete, or misleading.
Generated output is shown to you before it is used: nothing is added to a note until you insert it, and suggested changes to a note are applied only when you approve them. You are responsible for reviewing generated output before relying on it. We make no warranty as to its accuracy, completeness, or fitness for any purpose, and we are not liable for any decision made or action taken on the basis of it.
Availability depends on your hardware: these features require a physical device meeting the operating system and memory requirements stated in the app, and the models they use occupy storage on that device until you delete them.
To the maximum extent permitted by applicable law, Pear Notes and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the app.
Pear Notes may include links to third-party resources for convenience. We do not endorse, control, or assume responsibility for any third-party content or services.
The AI models used by the on-device AI features are produced by third parties and are downloaded from their providers' public hosting when you turn a feature on. Each model remains subject to its own licence — including MIT, Apache 2.0, MPL 2.0, and CC BY 4.0 — which is named in the app alongside the model. We do not control those models, the hosts that distribute them, or the output they produce.
We reserve the right to modify, suspend, or discontinue any aspect of Pear Notes at any time without notice. We are not liable for any modification, suspension, or discontinuation of the app.
We may revise these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of Pear Notes after any changes constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles.
